Electronic Signature Classifications under EU eIDAS

The eIDAS Regulation establishes three legal tiers of electronic signatures based on security, verification, and non-repudiation guarantees:

1. Simple Electronic Signature (SES)

4. It is linked to the data in such a manner that any subsequent alteration of the data is detectable.

3. Qualified Electronic Signature (QES)

A QES is an Advanced Electronic Signature created by a Qualified Signature Creation Device (QSCD) backed by a Qualified Certificate issued by a trusted trust service provider (TSP). Under eIDAS Article 25(2), a QES enjoys the equivalent legal effect of a handwritten signature in all EU member states.

Under 15 U.S.C. § 7001 (ESIGN Act), a contract or signature "may not be denied legal effect, validity, or enforceability solely because it is in electronic form."
